Oaks North Marbella Homeowners Association

BOARD OF DIRECTORS MEETING

May 20, 2009

The Board of Directors Meeting of the Oaks North Marbella Homeowners Association was held on Wednesday, May 20, 2009 at the Oaks North Community Center, pursuant to the notice thereof sent to all Board members. It was determined that a quorum was present and the meeting was called to order by the President, Karen Wiley at 10:00 a.m.

Directors present: Karen Wiley, Larry Allen, Jim Coote, Maurice Nahum, and Marilyn Tipler.

Also present: Ernie Giles, Chon Campillo (US Lawns), and Wendy DeVuyst.

MINUTES OF PREVIOUS MEETING

A motion was duly made by Larry Allen and seconded by Maurice Nahum to approve the minutes of the previous meeting of 4/15/09 as written. Motion carried.

MEMBER PARTICIPATION

A. Ernie Giles addressed the problem of brown areas on the greenbelt. The Board explained that we are cutting back the water in compliance with the City's water restrictions at this time. We are also not doing any extraordinary effort on the turf (such as aeration) due to the restrictions. We are also looking at a long range plan for the greenbelt to remove some of the turf. Also, we do not have enough water pressure and too many heads per valve which does not allow for proper coverage with the irrigation. This would be costly to correct. Discussion on the Eucalyptus trees and if they are a fire danger. Larry Allen feels that they are not a fire hazard as long as they are kept trimmed and no fuel is allowed to grow under them.

There was concern about the condition of a couple of properties in Marbella where the owners don’t appear to be maintaining their back yards very well. The City Fire Dept. will be notified to inspect these 2 homes to determine if they are a fire hazard.

Problems with people letting dogs run loose and speeding cars were brought up. We will put reminders in the next newsletter.

COMMITTEE REPORTS:

A. Maintenance … Karen Wiley

  • Punch List Items – A new list of items was given to US Lawns and reviewed. All the items from last month's list have been done. Need to add some plants at the entry. Perhaps some more Rosemary.
  • Backflow Leak - We had a backflow leak that US Lawns was able to repair. The leak was caused by someone tapping into our line to get some water. Discussion on putting a cap on the system so that it cannot be easily accessed. Unsure how this can be done.
  • Trimming of Entry Palms – Got a bid from Davey Tree for $1850 to trim the entry palm trees. This is the same price as last year. Discussion. We were unable to find a lower bid last year. A motion was duly made by Larry Allen and seconded by Marilyn Tipler to approve $1850 for the trimming of the entry palm trees. Motion carried. This work will be scheduled.

Committee Reports (continued)

  • Weather Station Clocks (Rebate Offer) – The original grant money from the County ran out, but they should have more funding in July. There is also another program starting up. US Lawns will continue to pursue this matter and make a presentation at the next meeting.
  • Water Pressure at Irrigation Valves – Larry Allen reported that the City still has not responded about checking our water pressure.
  • The Lyrp Pysslid pest is again affecting our Eucalyptus trees. We may have to look at removing some of the affected trees in the future.
  • Status of Entry Lighting – Jim Coote reported that all the lights are working. Have installed a mesh cover over one fixture.

B. Communications/Newsletter –The next newsletter will go out in July. Will include information on recycling household batteries. May need to follow up on painting mailboxes and spraying weeds in the street and sidewalk. Marilyn Tipler had some items for the neighborhood watch. She is working to put together the email list for mailings.

C. Long Range Planning Committee

· Relandscape Plan for Greenbelt – We will wait to get information from US Lawns on the Weather Station Clocks.

CORRESPONDENCE – None.

FINANCIAL REPORT … Maurice Nahum

A. Financial Statement - The statement ending 4/30/09 was reviewed and approved. We are about $11,152 under budget year-to-date.

B. Delinquent Accounts – There is one delinquent account that is 30 days past due.

UNFINISHED BUSINESS

A. Oaks North Community Center Architectural Review Committee (ONCC-ARC) – Karen Wiley reported that a lot of painting of homes is going on. The ARC is talking about banning any new plantings of Eucalyptus trees and all Palm trees. Discussion. Larry Allen disagreed with this position.

B. Rebuilding of Home on Via Tarifa – It appears that the house is completed and they will begin the landscaping. We need to review their landscape plan first. Will ask the ARC to request the landscape plans for approval.

C. Street Cracks - Maurice Nahum received an email from the City which asked for details as to the location of the street cracks. This information was given to them, but they have not responded.

D. Benches for Greenbelt – Jim Coote reported that he has a proto-type of a bench for the greenbelt for a cost of $203.16. The cost to install it in cement will bring the total cost to $450. Have contacted the affected neighbors and they have no problem. Discussion on the need to have a concrete base. It was felt that a concrete pad and footings was not necessary. This bench will be funded by private contributions. At this point we will only be installing one bench. A motion was duly made by Maurice Nahum and seconded by Marilyn Tipler to approve the type of bench being constructed and the location, as deemed by the Board, at no expense to the Association. Motion carried.
