Oaks North Marbella HOA Board of Directors Meeting (August 20, 2008)

Oaks North Marbella Homeowners Association

BOARD OF DIRECTORS MEETING

August 20, 2008

The Board of Directors Meeting of the Oaks North Marbella Homeowners Association was held on Wednesday, August 20, 2008 at the Oaks North Community Center, pursuant to the notice thereof sent to all Board members. It was determined that a quorum was present and the meeting was called to order by the President, Karen Wiley at 10:00 a.m.

Directors present: Karen Wiley, Larry Allen, Marilyn Tipler, and Jim Coote.

Also present: Rudy Farari, Lucille Lewis, Chon Campillo, (US Lawns), and Wendy DeVuyst.

MINUTES OF PREVIOUS MEETINGS

A motion was duly made by Jim Coote and seconded by Larry Allen to approve the minutes of the previous Board meeting of 7/16/08 as written. Motion carried.

MEMBER PARTICIPATION

A. Rudy Farari (18218 Corte de Casares) addressed the Board regarding a motorcycle being ridden on the streets in the early morning and in the evening by a young man. He called the neighbor about the problem. He seems to have slowed down and is not gunning the engine. It appears that the young man is staying at the house at 18184 Corte de Aceitunos to help with a medical situation with his parents and will be leaving in the near future. Discussion. Larry Allen will call and try to talk with the young man about the noise concerns.

Mr. Farari also brought up the palm trees at the entry possibly being a fire hazard. Karen Wiley stated that we had an expert out to review the trees and he felt that as long as we keep trimming the dead palm fronds off these trees are fairly safe. The cost to clean up the trunks or to remove the trees would be prohibitive. Discussion. Perhaps the Board should do some long term planning to eventually remove these trees. Karen Wiley will get some estimates on removals.

COMMITTEE REPORTS:

A. Maintenance … Karen Wiley

  • Punch List Items – New punch list given to US Lawns. Most of the items from last month were resolved.
  • Trimming of the Dead Pickle Weed along Paseo del Verano Norte - US Lawns wants to wait for the under growth to come up better. If it doesn't come up in about 3 weeks, they will trim it back and replant the area with cuttings.
  • New entry color was installed by US Lawns at the beginning of August at no charge.
  • US Lawns is watering either 3 to 4 times a week, depending on the area. We may need to change out the nozzles on some of the drip irrigation lines.
  • Ms. Wiley spoke with US Lawns about installing some bushes around some of the backflow units. Discussion. US Lawns was asked to provide a bid to install Texas Privet plants around these units.
  • Need to get bids to seal the asphalt walkway.
  • Status of Entry Lighting – Jim Coote reported that the lights are all on and the timer has been changed. A new lock was put on the timer box.

C. Long Range Planning Committee

  • Revisions to CC&R’s – The proposed amended CC&R’s and ballots were mailed out in June, with the ballots due back by 8/31/08. To date we have received 121 ballots. A special Board meeting will be held on 9/3/08 at 9 a.m. at the Center to count the ballots.
  • Relandscape Plan for Greenbelt – Karen Wiley and Marilyn Tipler have attended classes and met with a landscape architect to gather information on how to conserve water. Will also be getting a free water audit to evaluate our irrigation system next month. Will be discussed again next month. Discussion on water options.

CORRESPONDENCE – None.

FINANCIAL REPORT … Maurice Nahum was not present.

A. Financial Statement - The statement ending 7/31/08 was reviewed and approved. We are about $344 under budget year-to-date.

B. Delinquent Accounts – There are 3 delinquent accounts, with one of them in escrow.

C. 2009 Budget – Preliminary figures were reviewed. The budget needs to be approved at the October Board meeting and mailed out to all owners in November. Larry Allen will get some bids for tree trimming work for 2009.

UNFINISHED BUSINESS

A. Oaks North Community Center Architectural Review Committee (ONCC-ARC) – Karen Wiley reported that the shade cloth issue discussed at the last meeting has only been half repaired, but the owner has been notified to complete the job. There has been a lot of painting and relandscaping work done over the summer. We did receive a complaint about a possible fire hazard at a home. The person filing the complaint will be told to contact the fire department.

B. Update on Paint Colors/Recommended Approval by ONCC – We have not received a reply to the letter we sent to the ONCC regarding updating of the paint colors; however, this was approved by the ONCC Board. We will request a reply letter.

C. Rebuilding of Homes and Sale of Lots in Marbella – Karen Wiley reported that the plans for the home on Via Tarifa were submitted but are incomplete. There is a concern that the roof peak height is higher by about 2 feet than the original home. We have asked the builder to contact those neighbors who will see this house to see if they have any objections and to put up some poles and strings to show the configuration of the house when finished. We still need to get the final paint colors and the garage door view. The other homes under construction are looking very good.

D. RB United Meetings – Karen Wiley and Marilyn Tipler reported that they have attended meetings regarding fire danger and will have information for the newsletter.

E. Street Cracks - Maurice Nahum was not present.

F. Landscape Issues at 18034 Via Tarifa – Karen Wiley reported that she talked with the owner and they have removed the pile of cleaned up weeds and will be removing the tree in question when construction on the lot begins.

G. Possible Age Restriction Violation at 12935 Ave. Marbella – Karen Wiley reported that she checked with the ONCC and the owner lives out of state and that there is no

information on file about any residency. We will send a letter to the owner asking him to

complete a residency form.

NEW BUSINESS

A. Appoint Nominating Committee – It was suggested that Jay Riesenberg chair the Nominating Committee. Karen Wiley will check with John Ellis to see if he will also serve. A motion was duly made by Marilyn Tipler and seconded by Jim Coote to appoint Jay Riesenberg to chair the Nominating Committee and authorize the President to find two other members to serve on the committee. Motion carried. Maurice Nahum, Jim Coote and Marilyn Tipler have all decided to run for re-election.

B. Possible Age Restriction Violation at 18184 Corte de Aceitunos – Karen Wiley reported that this was discussed under Member Participation.

C. Location of Satellite Dish at 18295 Ave. Marbella – Karen Wiley reported that the ONCC ARC feels that they can pursue the location of the dish. Discussion. Ms. Wiley will inform the ARC that if they want to pursue the matter, they should send a letter to this owner.

With no further business to be brought before the Board, the meeting adjourned at 11:42 a.m.

Respectfully submitted,

Wendy DeVuyst, Recording Secretary
