BOARD OF DIRECTORS MEETING

June 17, 2009

The Board of Directors Meeting of the Oaks North Marbella Homeowners Association was held on Wednesday, June 17, 2009 at the Oaks North Community Center, pursuant to the notice thereof sent to all Board members. It was determined that a quorum was present and the meeting was called to order by the President, Karen Wiley at 10:01 a.m.

Directors present: Karen Wiley, Jim Coote, Maurice Nahum, and Marilyn Tipler.

Also present: Bob Weiland and Katherine Hollinger of Weiland & Associates, Greg Weiland and Chon Campillo of US Lawns, Rudy Fanari, Roberta Warnken, Mike Klaric, and Wendy DeVuyst.

MINUTES OF PREVIOUS MEETING

A motion was duly made by Jim Coote and seconded by Marilyn Tipler to approve the minutes of the previous meeting of 5/20/09 as written. Motion carried.

MEMBER PARTICIPATION

A. Mike Klaric addressed the Board regarding the Bylaws and the permanent removal of the turf. He feels that the Board is allowing the greenbelt grass to die, which he construes is a violation of the Bylaws. He claims we are not watering the greenbelt. Karen Wiley stated that the Board is currently watering 3 days a week and we are not removing the turf by allowing it to die. We are complying with the City mandated water restrictions at this time. The Board is still looking into possibly changing out the turf in some areas, but it would require a vote of the members. Discussion on the need for a special assessment to accomplish this goal. Mr. Klaric also feels that the Board should have set standards for any benches that are put on the greenbelt. He objects to the appearance of the latest bench that was installed.

B. Roberta Warnken feels that the Board has discretion for what is done within our Association, specifically with the new bench.

C. Roberta Warnken and Rudy Fanari would like to suggest that the Board consider removal of the entry palm trees as they are a fire hazard. Perhaps they can be removed a few at a time each year. Discussion. Marilyn Tipler suggested having a general meeting to discuss this issue and the greenbelt. Karen Wiley stated that if the palm trees are cut down, we would probably not be able to replace them.

D. Oaks North Community Center ARC representatives were here to discuss proposed rules on Palm trees. The fire marshal advised them that there needs to be 20 feet between palm tree trunks. The ARC stated that if Marbella wants to allow palm trees, then this Board should develop rules and enforce them for use in Marbella. The Board will discuss this matter at the next Board meeting.

Committee Reports (continued)

Maurice Nahum to approve the proposal from US Lawns for $220 for the entry plants.

Motion carried.

  • Backflow Access – Nothing new to report.
  • Trimming of Entry Palms – This work has been completed. No damage to lights or irrigation system.
  • Weather Station Clocks (Rebate Offer) – Katherine Hollinger of Weiland & Associates did a water usage analysis summary for Marbella and presented her findings. Discussion. There were some discrepancies in the figures and they will revise their cost estimates for water savings. Ms. Hollinger advised the Board that the County Water Authority has discontinued their rebate program at this time for weather station clocks and irrigation heads as they are out of money. However, the Metropolitan Water District is offering grant money that we could qualify for by having a water reduction plan. They presented a proposal to do a complete water analysis to determine how to modify the irrigation and landscaping to substantially reduce water use and costs. This would not involve the removal of all the turf areas. Their proposal is $1920 to do a Water Usage and Site Inventory Report. This would then allow us to submit for the grant money, which would be used to offset the implementation of the plan. Discussion. Ms. Hollinger and Bob Weiland, along with their landscape architect, would be available to attend a general meeting of our owners to review the plan. The Board thanked Ms. Hollinger and Mr. Weiland for attending. After the guest left the Board discussed proceeding with the Site Report. A motion was duly made by Marilyn Tipler and seconded by Maurice Nahum to engage the services of Weiland & Associates for a fee of $1920 to develop a Water Usage and Site Inventory Report. Discussion. Motion carried.
  • Water Pressure at Irrigation Valves – Larry Allen was not present.
  • Status of Entry Lighting – Jim Coote reported that all the lights are working.

B. Communications/Newsletter –The next newsletter will go out in July. Discussion on articles. We will cover the information on the greenbelt and a meeting of the members to review the information. We will also include information on the water restrictions and how they are affecting the Association.

C. Long Range Planning Committee

· Relandscape Plan for Greenbelt – This was discussed above under the Maintenance Report.
