The Board of Directors Meeting of the Oaks North Marbella Homeowners Association was held on Wednesday, January 16, 2008 at the Oaks North Community Center, pursuant to the notice thereof sent to all Board members. It was determined that a quorum was present and the meeting was called to order by the President, Karen Wiley at 10:01 a.m.

Directors present: Karen Wiley, Larry Allen, Marilyn Tipler, and Maurice Nahum.

Also present: Frances Blair, Peter Wolf, John Ellis, Chon Campillo (US Lawns), and Wendy DeVuyst.

MINUTES OF PREVIOUS MEETINGS

A motion was duly made by Marilyn Tipler and seconded by Maurice Nahum to approve the minutes of the previous Board meeting of 12/19/07 as written. Motion carried.

MEMBER PARTICIPATION

A. John Ellis and Peter Wolf were here regarding the rebuilding of the home at 18064 Calle Estepona. They discussed their concerns about the relocation of this home on that lot. Since the Board has not received the application for this property, we cannot comment on this matter. The ARC is having this Board review and approve the plans before they will approve them. These owners will be notified when the plans are received as they must sign off on the application form as the neighbors.

COMMITTEE REPORTS:

A. Maintenance … Karen Wiley

· Punch List – All items from the last list have been done. A new list was given today and discussed. Concern over use of bark in planter areas. We may want to change that the bark to rock at some point in the future when it needs to be changed out again.

· Fire Damage to Landscaping – Will wait until spring before the new plants are installed. Will have the entry trees reviewed in the next 6-8 months to see if they will survive. Will have the insurance adjuster out at that time.

· Irrigation Water Bill – There was a large increase on one of the water bills. No leaks were found in the system. Discussion. We will call out the Water Dept. to check the meter. The irrigation water is only on now twice a week. It had been off for several weeks.

· Debris from Entry Palms – After the last winds there was a lot of debris from the entry palms. A resident cleaned up the debris. If there is a lot of debris, the Board will contact US Lawns to come out.

· Painting of Wrought Iron Fence Damaged by Fire – This work was done before Christmas.

· Status of Entry Lighting – Jim Coote was not present.

B. Communications/Newsletter – Newsletter to go out in February. Articles will include: commercial signs; Palm trees at entry; construction traffic; reconstruction of homes; new roster to come out.

C. Long Range Planning Committee

  • Revisions to CC&R’s – The Board is to have reviewed the revisions by the next Board meeting. If they have any questions, they will contact the attorney so that they can finalize the revisions for mailing to the owners for a vote.
  • Relandscape Plan for Greenbelt – Marilyn Tipler has arranged for the Board to meet with a contractor from Day Lily Nurseries to review plant ideas for relandscaping the greenbelt.

CORRESPONDENCE

A. Correspondence with our insurance carrier regarding the fire damage claim. The Association received a total of $4175 for the Common Area damages due to the fire.

FINANCIAL REPORT … Maurice Nahum

A. Financial Statement - The statement ending 12/31/07 was reviewed and approved. We are $775 under budget year-to-date.

B. Delinquent Accounts – There are no delinquent accounts at this time.

UNFINISHED BUSINESS

A. Oaks North Community Center Architectural Review Committee (ONCC-ARC) – Karen Wiley has been attending the ARC meetings. Most of the recent applications have been for fire damage repairs. We did approve one set of plans for rebuilding one of the homes destroyed in the fire. There was a question on the roof tile, which has been resolved. We will use this tile as the only option on all of the homes destroyed in the fire. Three of these lots are for sale. There was a question about time frame for rebuilding on the lots. Discussion. The proposed updated CC&R's require construction to start within 90 days. The Board felt that this was reasonable and will use that standard.

B. Construction Traffic Through Marbella – Larry Allen attended a meeting on Monday with the RB United Group and they did discuss construction traffic. They are working up a plan to direct traffic in all construction areas. The problem of speeding in our area was discussed and we are asking for a police presence occasionally to monitor the traffic.

NEW BUSINESS

A. Insurance Renewal – We received a quote to renew our insurance that will expire on 2/1/08. The premium went from $4287 last year to $5096 for this year. Discussion. We will ask our broker to shop for lower rates. A motion was duly made by Marilyn Tipler and seconded by Maurice Nahum to approve up to the $5096 for the insurance premium, with the condition that we get additional insurance quotes. Motion carried.

With no further business to be brought before the Board, the meeting adjourned at 10:56 a.m.

Respectfully submitted,

Wendy DeVuyst,

Recording Secretary

NEXT BOARD MEETING: Wednesday, February 20, 2008 at 10:00 a.m.
