Oaks North Marbella Homeowners Association

BOARD OF DIRECTORS MEETING

December 19, 2007

The Board of Directors Meeting of the Oaks North Marbella Homeowners Association was held on Wednesday, December 19, 2007 at the Oaks North Community Center, pursuant to the notice thereof sent to all Board members. It was determined that a quorum was present and the meeting was called to order by the President, Karen Wiley at 10:00 a.m.

Directors present: Karen Wiley, Larry Allen, Marilyn Tipler, Jim Coote, and Maurice Nahum.

Also present: Linda Dickerson, Chon Campillo (US Lawns) and Wendy DeVuyst.

MINUTES OF PREVIOUS MEETINGS

A motion was duly made by Marilyn Tipler and seconded by Maurice Nahum to approve the minutes of the previous Board meeting of 11/14/07 as written. Motion carried.

MEMBER PARTICIPATION

A. Linda Dickerson (13005 Camino Ramillette) was here regarding the truck traffic for the fire damage work. She was counting between 50 to 70 trucks per day going down our road and most were not stopping at the stop sign at Ramillette and Estepona. As of now most appear to be going through the Villas, with a staging area on Paseo del Verano Norte. However, as the building starts, there will many more trucks on our streets. She understands that the homes in the Trails closet to our neighborhood should access this area, but not the rest of the Trails. Karen Wiley stated that we have had another complaint about this situation, but we are unsure what our Board can do since these are City owned streets. We are looking into this matter. Discussion. The consensus of the Board was that we should make a presentation to the Traffic Committee and the RB Planning Board outlining our concerns.

COMMITTEE REPORTS:

A. Maintenance … Karen Wiley

· Punch List – All items completed from the last list. New punch list given to US Lawns today. We paid $30 for additional color at the entry at the end of November. Irrigation water has been turned off during the rains.

· Fire Damage to Landscaping – The lemon trees that were burned and the plants in the Citrus grove that were lost in this area were not included in the bids from US Lawns. We need to get a bid for this replacement. US Lawns has done a lot of the work to replace damaged irrigation, planter beds, etc.

· Tree Removal Work – JRS was called out and they removed one burned tree and one tree damaged by the winds in the upper greenbelt area for a cost of $300. The Board approved this expense.

· Painting of Wrought Iron Fence Damaged by Fire – Ms. Wiley received a bid from Certa-Pro Painting for $1440 to repaint the fence that was damaged in the fire. Discussion. A motion was duly made by Jim Coote and seconded by Marilyn Tipler to authorize Cert-Pro to do the painting work on this fence for $1440. Motion carried.

· Status of Entry Lighting – Jim Coote reported that he will need to purchase additional sockets. Had to rebuild one fixture this past month. All lights are now on.

Committee Reports (continued)

B. Communications/Newsletter – Newsletter to go out in February. Karen Wiley noted a lot of signs on properties for contractors. Will put something in the next newsletter about this problem. The problem with the construction traffic will also be addressed.

C. Long Range Planning Committee

  • Revisions to CC&R’s – Will work on this after the first of the year.
  • Relandscape Plan for Greenbelt – Most of the Board met with US Lawns yesterday to review the proposal. The Board wants to address only those areas that are the worse and will not remove all the sod. Discussion. Larry Allen feels that we should have an outside landscape architect review this area and eventually draw up plans, rather than using US Lawns. He also feels that we should not draw up anything until we know what the City will do as to water rationing. Marilyn Tipler will get a drought tolerant professional to review our area and review the plants they utilize. The Board will gather information on this issue and then decide how to proceed.

CORRESPONDENCE

A. A letter dated 11/1/07 was received from the trustee of 13347 Corte de Chucena with an address change and requesting information on monies owed on this account. A reply letter dated 11/12/07 was sent advising that the unit was current on the dues and the next payment would be due as of 1/1/08. A response was received on 11/15/07 asking for a set of CC&R’s and Bylaws for the Association and notifying that the unit was being sold. A reply letter was sent on 11/16/07 advising that he needed to contact the bookkeeper to arrange for these documents as a part of the escrow process. The home has since been sold and closed escrow.

C. A letter was received on 11/16/07 from the property management firm for 18163 Corte de Aceitunos asking about the fence that was damaged in the fire. They were unsure as to who owned the fence. A reply letter dated 11/16/07 was sent advising that the Association was responsible for the fence and we would be having it repainted. We also advised them to get an architectural application for changes they are proposing to make in the front yard landscaping.

D. Letters were sent on 11/20/07 to the six fire victims, along with copies of the Bylaws and CC&R’s, the Articles of Incorporation, an architectural application and the original sales maps showing the different models.
