November 14, 2007

The Board of Directors Meeting of the Oaks North Marbella Homeowners Association was held on Wednesday, November 14, 2007 at the Oaks North Community Center, pursuant to the notice thereof sent to all Board members. It was determined that a quorum was present and the meeting was called to order by the President, Karen Wiley at 10:00 a.m.

Directors present: Karen Wiley, Marilyn Tipler, Jim Coote, and Maurice Nahum.

Also present: Lynn Shima, Geri Martinez, Dorothy Daley, Chon Campillo (US Lawns) and Wendy DeVuyst.

MINUTES OF PREVIOUS MEETINGS

A motion was duly made by Jim Coote and seconded by Maurice Nahum to approve the minutes of the previous Board meeting of 10/17/07, the Annual Meeting of 11/7/07 and the Organizational Board meeting of 11/7/07 as written. Motion carried.

MEMBER PARTICIPATION

Lynn Shima and Geri Martinez spoke about a neighbor that has not cleaned his hillside. They have spoken with him prior to the fire and he had not done any work. There was fire damage on this slope. Discussion. The ARC and the Board advised that they contact the Fire Dept. if they feel this is a fire hazard. There are 4 homes that have large slopes and they are asking that the Board consider some help to these owners in maintenance or water compensation. The Board stated that they cannot compensate them or maintain any of this area as it is deeded to them.

COMMITTEE REPORTS:

A. Maintenance … Karen Wiley

· Punch List – New list given. Most items from last month have been completed.

· Irrigation Problems on Greenbelt – US Lawns did add the one sprinkler to one area and it is providing better coverage.

· Fire Damage to Landscaping – Found another area of fire damage by Corte de Chucena. Need an estimate from US Lawns for these repairs. They will begin work on the other fire damaged areas where the Board has already approved the proposals. Will replant the slope on Paseo del Verano Norte after the fence painting is done. We have about 141 linear feet of wrought iron fence and one pillar that needs to be repainted. We are awaiting a bid. It appears we may have a property line situation with a house at the end of Corte de Aceitunos. We will pursue this with our attorney.

· We had a tree damaged by the wind that needs to be removed. We are getting a bid for this work.

· Status of Entry Lighting – Jim Coote reported that there are 2 lights out and he will get them operational. It was reported that a spot light on Marbella sign was flickering last night. Mr. Coote will check this light.

B. Communications/Newsletter – Newsletter was sent out.

C. Long Range Planning Committee

  • Revisions to CC&R’s – Copies of the proposed changes were given to the Board for review. They will review after the first of the year.

This is the same firm that has done it in the past and is a $25 increase over last year’s cost. Discussion. A motion was duly made by Jim Coote and seconded by Marilyn Tipler to approve the audit proposal for $900. Motion carried.

UNFINISHED BUSINESS

A. Oaks North Community Center Architectural Review Committee (ONCC-ARC) – Karen Wiley reported that she and Marilyn Tipler attended yesterday's meeting. Dorothy Daley will stay on the ARC as our representative for a time. Ms. Wiley and Ms. Tipler will handle the ARC issues while Ms. Daley is away. At the meeting they discussed the rebuilding issue with fire damaged homes. It was agreed that the homes must be the same size and have the same façade look on the front of the homes.
