Board of Directors Meeting, Jan. 18, 2006, Minutes

Oaks North Marbella Homeowners Association
BOARD OF DIRECTORS MEETING
January 18, 2006

The Board of Directors Meeting of the Oaks North Marbella Homeowners Association was held on Wednesday, January 18, 2006 at the Oaks North Community Center, pursuant to the notice thereof sent to all Board members. It was determined that a quorum was present and the meeting was called to order by the President, Karen Wiley at 10:02 a.m.
Directors present: Karen Wiley, Jim Coote, Marilyn Tipler, Jay Riesenberg, and Larry Allen. Also present: Marjorie Rohan, Chon Campillo (US Lawns), and Wendy DeVuyst.

MINUTES OF PREVIOUS MEETING
The minutes of the previous Board meeting of 11/16/05 were reviewed and the following correction was noted: On page 2, under “Unfinished Business”, item “A”, last sentence should read, “Mr. Allen will have …”.
A motion was duly made by Karen Wiley and seconded by Marilyn Tipler to approve the minutes of the previous Board meeting of 11/16/05 as corrected. Motion carried.

MEMBER PARTICIPATION
A. Marjorie Rohan (18395 Aceituno) was here concerning the number of cars parking on the streets rather than in the garages or on the driveways. Since there is nothing specific in the CC&R’s which requires residents to park in their garages, we cannot force the issue. However, we will put an item in the next newsletter asking for voluntary compliance.

COMMITTEE REPORTS:
A. Maintenance … Karen Wiley
Punch List – Ms. Wiley presented a new punch list of maintenance items that US Lawns needs to address. Discussion.

Status of the Last Punch List – Most of the items have been completed on the list from November 2005.
  • Irrigation System – US Lawns now have the sprinklers on three times a week. It was noted that one of the backflow units is leaking. US Lawns can repair for around $85. Board approved. Ms. Wiley called US Lawns on 12/27/05 to report some sprinkler problems. It turned out that two valves were leaking and had to be repaired for a cost of $350. Ms. Wiley feels that the foreman for US Lawns should have discovered this problem.
  • Seed Bare Areas – US Lawns still has not done the sample area of reseeding to see if it will take.
  • Aerate Grass – US Lawns did complete the second aeration.
  • Bid to Overseed all Turf with Rye Grass – This was tabled.
  • A walk through needs to be scheduled with US Lawns.
  • Gophers are an on-going problem. They are putting out traps and poison.
  • Tree Trimming Work – Larry Allen reported that Sutton Tree Service completed the tree work in December. An adjustment was made to the billing after we counted the number of trees they cut. The final bill was for $7142
  • Status of Entry Lighting – Jim Coote reported that all the lights are on. He is out of bulbs and will need to purchase more. It was noted that the electrical control box for the light timer is rusting and should be replaced. This will be checked.B. Communications/Newsletter
  • The newsletter will go out this month. Discussion on articles.
  • Discussion on the possibility of renting a large dumpster for a one-time rental for residents to use to dispose of large items. Due to liability concerns the Board decided against this idea.
C. Long Range Planning Committee
  • Revision of CC&R’s – Karen Wiley, Marilyn Tipler and Larry Allen met with the attorney on 11/30/05 and reviewed the boiler-plate version of the CC&R’s that he sent to us. Ms. Wiley will follow up with the attorney on the status of the revisions discussed.
  • Election Procedures - It was noted that new State law that goes into effect on 7/1/06 will require that the Board adopt Election Procedures. We need to have the attorney review the draft of these procedures, then we need to advise the owners in the newsletter when the Board will be voting on the procedures and how they can give their input.
  • Holiday Decorations – Marilyn Tipler reported that Roland Kramer has offered to put up holiday decorations next year on the entry walls to Marbella. He provided some drawings of what he would do. Discussion. The Board asked that he attend the next Board meeting to discuss his ideas.
CORRESPONDENCE
A. A letter dated 11/18/05 was sent to Rosann Feldman (18403 Aceituno) confirming her conversation with the Board at the meeting on 11/18/05 in that she would provide a letter from her daughter’s doctor stating that Ms. Feldman needs to have her daughter living in her home so she can care for her. A letter dated 12/10/05 was received from Ms. Feldman along with the doctor’s letter.
B. A letter was received complaining that a male homeowner in Marbella was harassing female dog walkers on the greenbelt. The letter states that he yells and threatens these women if their dogs are not kept on a short leash. Discussion. Because this homeowner is not violating any of the CC&R’s, this Board cannot take action. A reply letter will be sent to the person who complained.
C. A letter dated 11/21/05 was sent to 25 owners in Marbella asking that they do repairs or painting work to their mailboxes and/or mailbox posts. Three reply letters were received. The non-resident owner of 12965 Camino Ramillette wrote on 12/28/05 to say that no work was necessary to his mailbox. A reply will be sent indicating that his neighbors apparently painted his mailbox for him.
D. A letter dated 11/23/05 was received from the ONCC providing us with occupancy information for 12985 Ave. Marbella. The occupancy form that was filled out indicated that the owner’s underage daughter was currently residing in the house.
E. A letter dated 12/12/05 was received from an owner with a correction to her listing in the Marbella Directory. A reply letter dated 12/15/05 was sent acknowledging the requested change.

FINANCIAL REPORT … Jay Riesenberg
A. Financial Statement - The Board reviewed and approved the financial reports ending 11/30/05 and 12/31/05. The year-end statement shows that we ended the year $9738 under budget. However, this does not reflect the tree trimming bill for $7142. We will have this adjusted.
B. Audit Proposal – A motion was duly made by Marilyn Tipler and seconded by Karen Wiley to approve the proposal from the CPA firm of Lanning & Owens to do our annual audit and tax preparation work for a fee of $900. Motion carried.
C. Collection Policy - Due to new State laws the Collection Policy was updated to reflect the changes.

UNFINISHED BUSINESS
A. Oaks North Community Center Architectural Review Committee (ONCC-ARC) – Larry Allen reported that there were no meetings of the ARC over the holidays. Discussion on tree trimming guidelines for view issues.
B. Stop Signs at Camino Ramillette and Calle Estepona – All the STOP signs have been installed.
C. Maintenance of Mailboxes – Karen Wiley reported that all the mailbox painting and repair work has been done.
D. Possible Age Restriction Violation at 12985 Ave. Marbella – The Board directed that a letter be sent to this owner reminding her that her daughter may only reside in her home for a maximum of 60 days in any calendar year.

NEW BUSINESS
A. 2006 Marbella Directory – Marilyn Tipler and Wendy DeVuyst have been working to update all the directory listings. Discussion. The Board directed that we have the directory printed up and mailed out with the newsletter.
B. Insurance Renewal – We have received a quote for the General Liability and Directors and Officers Liability insurance which expires on 2/1/06. The quote is the same as last year’s premium of $4574. A motion was duly made by Jim Coote and seconded by Jay Riesenberg to approve renewal of the insurance for $4574. Motion carried.

With no further business to be brought before the Board, the meeting adjourned at 11:42 a.m.

Respectfully submitted,

Wendy DeVuyst,
Recording Secretary
